The following terms set out the relationship between Everjewel.com ("Everjewel", "us", "we", "our") and you ("you", "your", "buyer", "seller", "customer", "member"). We provide buyers and sellers (referred to as, respectively, "buyers" and "sellers" and, together, "users") with an e-commerce platform (the "site","service") that enables the sale and purchase of items. These terms are legally binding and apply whenever you use the site. By accessing and/or using our site or services you agree to be bound by these terms. You are not permitted to use the site or services if you are under the age of 18. By using our site or services, you warrant that you are over 18 years of age and that you understand that if you transact using our site or services that you are entering into a legally binding contract with another user.
By accessing and using our site and services you agree to the terms and conditions. If you do not agree to these terms, you may not access this site or use the services. Everjewel also makes available optional add-on software applications "Apps". By installing "Apps" provided by Everjewel you agree to these terms. These may change from time to time. Updated terms will be posted on this site. Before using our site or services on any occasion you should always check whether these terms have changed. If you use our site or services, it is the latest version of these terms which is legally binding on you.

Everjewel is committed to ensuring the quality of your purchase so we stand behind everything that we sell and warrant that all items will be free from any manufacturing defects at the time of delivery. All of our jewelry is manufactured using the highest quality materials and is inspected prior to shipment. Items included in our lifetime warranty are: free prong tightening, re-polishing, rhodium plating and cleaning services.
Please Contact Us if you have any questions or would like to return your item(s) to take advantage of our free lifetime warranty or request additional repair work needed to service your Everjewel purchase. To send us your ring, U.S. customers may purchase a fully insured shipping label for $35. International customers will be subject to return shipping cost applicable to their order. We will ship your item back to you at no cost to you.
Free Shipping Worldwide
We will ship any item purchased to you anywhere fast and free. All items are securely packaged and fully insured while in transit to your home or office. Most items showcased on our website can be purchased for overnight shipping and delivered directly to your home.
US orders greater than $10,000 in value are shipped via USPS Priority Express or FedEx Priority Overnight. International orders over $10,000 in value are shipped via FedEx International Priority. US orders under $10,000 in value are shipped via USPS Priority or FedEx 2Day Saver. International orders are shipped via FedEx Economy or USPS International. Order status and tracking information are given from the Everjewel order status email you will receive at the time of purchase.
Please note: We only ship your order once it has passed through our thorough quality control.
For your protection, Everjewel always:
- Insures all items for their full value.
- Uses only USPS or FedEx services for all orders, in order to deliver high value packages in the fastest and safest manner.
- Requires that all deliveries be made to a physical business or home address.
- Will not deliver to a PO Box addresses.
- Always requires a signature for the package.
- Allows for an alternative shipping address.
We suggest that any credit card order be shipped to a valid address on file with the credit card company, although alternate addresses are acceptable. We can also arrange to have your package shipped to a local FedEx station for pick-up. You may call our offices at any time for assistance locating the nearest FedEx facility.
International customers will be responsible for any duties, VAT, taxes or surcharges levied or charged by their country, so please check with local authorities prior to placing your order to confirm taxes and duties.
We stand behind every item we sell and want you to be completely satisfied with your purchase. If, for any reason, you are not completely satisfied with your order, you may return it within the first 30 days of shipment for a full refund or exchange - we even pay for the return shipping. Free returns apply to U.S and Canada customers only and are limited to one per customer.

- Advise the representative that you wish to return your order.
- Within one business day of your phone call we will email you a pre-paid, fully insured USPS Priority 2-Day label, along with instructions on how to safely and securely package your items.
- Take your order and the label to the nearest US Postal location and simply mail it back to us! If you need packaging materials, USPS will assist you.
- All refunds will be processed within two weeks and done in the form of the original purchase method. Bank wires will be refunded via company check and Bitcoin (BTC) will be returned via the BTC address you provide during the return process. BTC returns will be for a specific US dollar amount, not a specific (or the original) BTC paid at the time of your original purchase.
Improperly packaged items:
Items sent to our office without a Return Authorization Number, packages shipped beyond the 30-day return period, and packages that are improperly packaged or uninsured will be refused receipt.
Damaged and Used Items:
Returned merchandise must be undamaged and in "new and unused condition." Items showing obvious signs of wear or alteration by a jeweler other than Everjewel will not be accepted.
Loose diamonds must be accompanied by the original laboratory grading report or a $200 charge will be assessed to replace the certificate with a new one.
Special orders cannot be returned.
We will not use or disclose your personal information other than for the purposes of collection described in this policy or for purposes for which we have received your consent, and always in accordance with the privacy settings you have selected.
INFORMATION COLLECTED OR RECEIVED
We collect, use and disclose only that information which is required to enable us to manage your account, identification and authentication purposes, for service improvements, to provide our services, to maintain customer/visitor lists, to respond to inquiries, and to address malicious use of our services.
"Personal information" is any information that can be used to identify you. We collect personal information about you if you provide it to us knowingly. This includes your name, address, telephone number, email address, or credit card or financial account details.
We may also collect personal information from third parties, such as our service providers, business affiliates and credit reporting agencies. Generally speaking, we will provide you on request with access to the information we hold about you. If there is a reason why we can't give you access to such information, we'll let you know. If you advise us of any errors relating to your personal information held by us, we will amend your personal information to correct them.
When you register as a user of this site, or contact us, we collect your full name, email address, telephone number, address, and in some cases, your financial and credit details, together with other information as may be requested on the registration form, transactions, user support or surveys from time to time.
We will collect personal information from users only if they voluntarily submit such information to us. It is the choice of the user whether to provide personal information, however, If a user does choose not to provide certain requested personal information that user in certain circumstances will not be able register or able to use certain features of the site.
We may collect personal information from our third party service providers, such as credit reporting agencies. We use this information to provide our services to you, to administer this site and to enable third parties such as sellers to provide services to you, as well as for the other purposes set out in this policy.
HOW WE USE AND SHARE
We use the information that we gather from our users in a number of ways, including to provide and improve our services, for targeted online marketing, and to communicate with you. We also partner with service providers and other third parties that collect, use, and analyze information about Everjewel users. We will only use or disclose your personal information or sensitive information for the purposes for which you have provided it to us, and as set out in this policy, unless you have consented to the use or disclosure; or it is necessary to comply with the law.
We collect information for the following purposes:
- In order to facilitate the buying and/or selling of items and services on our site;
- To personalize the user experience;
- To provide users with transactional notifications such as un-subscribing, registration confirmations, confirmation of account changes, or emails relating to a user's account or changes in the site terms or policies;
Your personal information is collected so that we, as well as our related entities and business affiliates can promote and market our/their services to you (including by way of direct mail, telemarketing, email, SMS and MMS messages). This is to keep you informed of products, services and special offers and may continue even after you have stopped using this site. However, this will be done only in accordance with the privacy settings you have selected. We require that third parties with whom we share your personal information safeguard it the same way we do.

Product Evaluation Policy
DIAMONDS & COLORED GEMS
Everjewel will evaluate the item sold to be exactly as represented. This evaluation is done using industry standards and methods with the latest technology. Our diamond grading is performed utilizing the GIA (Gemological Institute of America) grading standards which we feel are the most accurate standards. Everjewel will not remove gemstones or alter the jewelry it is evaluating in any way. All mounted diamonds and gems will be weight estimated using industry standard measuring procedures.
Our graders and appraisers are GIA Graduates and experts in their respective fields. All diamonds and gemstones that are accompanied with a third party certificate will be evaluated for everything else using the Everjewel Evaluation Process and the diamond or gemstone listed in the certification will not be evaluated for it's quality but only that it is genuine and the certification has been issued by the company listed on the certification and is in the certification company’s database.
Any diamond or gemstone that is weight estimated will be given an approximate size that will be evaluated against the weight described by the seller. Because it is mounted, the estimated weight will be given a 10%+/- allowance for the inability to actually weigh it on a scale. All diamonds are graded for:
- Weight estimated using industry standard measurement estimations. All loose diamonds are weighed directly on a certified carat scale.
- Color is estimated using a GIA master color grading set as well as colorimeters for dual identification.
- Certain Clarity Enhancements (fracture filled, laser drilled)
- Currently, Everjewel does not offer evaluation or protection for diamonds or gemstones that have certain Color Enhancements such as Irradiation, HPHT, and specialty coatings.
- Checked against simulants and synthetic diamonds such as: (Moissanite, Agape and others) using DeBeers DiamondView and DiamondSure testing equipment.
All gemstones are graded using strict AGS (American Gem Society) standards with the latest grading equipment for quality and color. To evaluate a gemstones authenticity and quality we may use Polariscopes, Spectroscopes, Infared Reflectance Meters (Jameter) and Refractometers. Everjewel does not test a gemstone for color enhancement. If a gemstone is accompanied with an industry accredited certification, Everjewel will authenticate the certification with the issuing agency. Everjewel does not offer evaluation against certain color enhancements unless the gemstone is accompanied with a certification where Everjewel will then validate the certificate with the certificate issuing company.
KARAT METALS, PLATINUM & SILVER
Everjewel will evaluate the jewelry to contain the exact precious metal it has been represented to be. We may use the latest X-Ray and scanning technology to ensure the purity of the item. We authenticate the following precious metals:
- Gold from 10kt to 24kt pure.
- Platinum from 50% to 100% pure.
- Silver from Sterling (92.5%) to 100% pure.
We do not evaluate any other metals other than those listed here.
Everjewel will evaluate all Swiss luxury watches for authenticity. Our expert staff of certified appraisers will remove the back cover of every watch to evaluate the movement to be genuine as well as the case and band. All precious metal watches will be authenticated using the KARAT METALS, PLATINUM & SILVER method mentioned herein. Any watch containing stones will be authenticated using the DIAMONDS & GEMSTONES method mentioned herein. We will not remove a movement or crystal to evaluate any gemstones on the dial of a watch.
All accessories will be evaluated using the methods mentioned herein for all the respective attributes of the item. All branded items will be evaluated in the same manner.
By selling mounted diamonds or gemstones on Everjewel you hereby agree to this evaluation method.
Dealer Guidelines & Fee Agreement
We’re glad you’ve decided to become a trusted dealer for Everjewel. Let’s go over some important items that are designed to help you and Everjewel have the best experience possible.
A “dealer” is anyone who falls within any of these structures: Dealer, Wholesaler, Distributor, Vendor, Manufacturer, Reseller, and anyone conducting business within a legal business entity for the sake of buying and/or selling jewelry or jewelry services.
You can enjoy success on Everjewel.com by following these guidelines on how to maintain a transparent shop, provide great customer service, and respect our community. By transacting on Everjewel.com you, the seller, agree to the following:
EVERJEWEL’S MISREPRESENTATION ENFORCEMENT:
You agree to use the industry’s best practices to represent your item correctly. Everjewel does not allow or tolerate misrepresentation of an item’s details, whether in the language or photography. Everjewel allows an up to +/-10% leniency deviation for such occasions that warrant the need for it, (i.e. a stone can’t be removed to figure an exact weight, so estimation is needed). We do not allow this leniency where it is not necessary. The first infraction will be settled with a warning and sending back of the item to the dealer with the return shipping cost being billed to the dealer. The second infraction will be a suspension of the dealers account and reevaluation to determine if the dealer will be allowed to continue to sell on Everjewel. If allowed to continue, a third infraction will result in the immediate closing of the dealer’s account and removal of all products for sale from the dealer within Everjewel. We feel this promotes healthy successful business practices for all. The Everjewel brand is based solely on being a safe and secure place to buy and sell jewelry. When all dealers and sellers adhere to this policy, buyers will continue to purchase, share the experience and return.
You agree to offer only jewelry related products. You agree not to offer any illegal items. You also agree not to offer for sale, sell, or post content which promotes tobacco products, illegal drugs, prescription medication, hazardous or restricted items, offensive material, counterfeit items, personal information in any form, police badges or uniforms, stolen property, shares, securities or other financial products, blood, bodily fluids or body parts, weapons, explosives, ammunition, obscene material, pornography, banned adult products, gambling/betting products or services, or copyrighted / branded goods that you do not own or have all the necessary rights to offer for sale or promote. You agree that the decision as the whether any product falls within any of these categories will be made by us, acting reasonably.
You may not collect data from users or otherwise use any data that is obtained from our site or services unless you have our written permission. You must not download software or other code on to a user's system without the consent of the user.
In the product description, you must make clear to prospective buyers the period for which the item is available, as well as any terms and conditions that apply to the item, or any limitations or restrictions that apply.
Dealers, Vendors, Suppliers and Manufacturers and anyone operating at a wholesale level must maintain on-hand inventory of the item(s) being offered for sale. If an item is only available to be made after the order is placed, then this information must be detailed in the description of the item, (e.g. “this item will ship 7 days after order is placed”, etc...). If you must temporarily remove an item for sale on Everjewel, you may do so from within your account, manage products section. You must honor your shipping and processing times. You must respond to communication from Everjewel and/or Everjewel in a timely manner.
If you are unable to complete an order, you must notify Everjewel immediately.
Everjewel reserves the right to cancel a transaction if the item is sold and seller does not ship the item in the specified time-frame which is 48 hours from seller's confirmation of the item sold.
DEALER FEE AGREEMENT
We look forward to allowing dealers to utilize the expansive Everjewel platform in many ways.Everjewel does not charge to post your item for sale.
- Standard Fee: When a dealer sells to anyone on Everjewel (i.e. “the public”),the standard 15% fee will be charged for the sale.
- All prices and fees are in US Dollars.
- When the
transaction is dealer-to-dealer, the purchasing entity will not receive Everjewel packaging or other services for the product unless specifically ordered at the point of checkout.
Everjewel will deduct the applicable service fee from the funds received in relation to each transaction.
Amounts received on your behalf from our payment gateway, after deducting any amounts due to us, will
be remitted to you
r bank account (if you are based in the US) or your Paypal account (if you are based
outside the US) on the 1st and 15th of each month.
LISTING TERM PERIOD
All items will remain listed for sale for 60 days, until the item is sold or the user deletes the item from their
products offered for sale within their profile. The seller will receive notification from Everjewel when the
item is 7 days from expiry and on the day of expiry.
Any product that is placed in a user’s shopping cart
will be extended from expiry for the duration of being in the shopping cart.
PREFERRED PLACEMENT FEES
Everjewel future offers will include, but not limited to: advertising opportunities to increase the visibility of your item(s) and store. Advertising fees vary by opportunity. Preferred Placement fees will be clearly outlined before you commit to purchasing an ad. Preferred Placement fees will be charged whenever the listing term is over, whenever the item sells, or whenever the chosen click rate fee has been exhausted.
SHIPPING / SHIPPING INSURANCE FEES
Everjewel is not responsible for damage to valuables which occur during shipping to Everjewel from you. Please secure and appropriately package your product. We advise you not to indicate on the package that there are valuables inside. We reserve the right to reject a package which appears to be damaged, opened, or tampered with. Any rejected item will be returned to you in the manner it was received. The seller assumes the cost of shipping and responsibility of supplying shipping insurance from the seller to Everjewel. Once received at Everjewel's facility, Everjewel is responsible for shipping and shipping insurance to the buyer. The seller will be charged a shipping fee if the item is found to be unsatisfactory during the Everjewel Evaluation Process. Everjewel will immediately ship the item back to the seller with proper insurance and charge the seller for the shipping cost.
We may charge you the following additional fees:
- USD$30 if we are required to investigate a dispute and process a refund;
- USD$35 if we are charged a charge-back fee from our payment gateway provider;
- USD$50 if you have a deficit fund balance and you fail to pay our invoice within 7 days of receiving the invoice from us.
